NOTE: * SB298 signed on 7/22/22 amended Title 26 of DE Code Net Metering; increased utility cap from 5% to 8%; once the 8% cap has been reached, new solar customer will no longer be eligible for the NEM program

Customers to be credited in kilowatt-hours (kWh) for any excess production of their generating facility that exceeds the customer’s on-site consumption of kWh in a billing period (an “Excess kWh Credit”). Excess kWh Credits shall be credited to subsequent monthly billing periods to offset a customer’s consumption in those billing periods. Excess kWh Credits at the end of the annualized billing period shall revert to the electric distribution company providing electric distribution to the customer.

System Offset Notes

The system size is based on the customer’s most recent two-year average (last 24 months) energy consumption. The average takes into account any statistically outlying months. The system production must be less than 110% of this annual average. If there is no history for the location the City of Milford will provide an estimate based on similar neighborhood houses and situations. The City will not approve an oversized system resulting in the customer becoming a generator.

To be eligible for the net metering service, the generating capacity of a system cannot exceed the customer’s annual electric energy needs. Systems over 25kW may require a pre-interconnection study and other requirements as described in the City of Milford electric rules and regulations

Meter Spot Process

The meter alarms on reverse energy and causes issues with our billing system. Testing of the interconnection should take place after permission to operate.

The City of Milford does not require a production meter. The existing utility meter is all we require. Our utility meter measures the energy the utility delivers to the customer and the energy the customer returns to the utility. The utility meter does have to be located on the house. If the existing utility meter is located on a pedestal near the street it must be moved to the house before any construction will be approved.

Utility Meter:

The utility meter must be located on the structure adjacent to the system disconnect device. If the meter is located on a pedestal near the street the meter will need to be moved to the structure by the customer/contractor before the interconnection application will be approved.

Disconnect:

The City of Milford requires a system disconnect device be installed adjacent to the electric meter. This disconnect device must be clearly marked and accessible to the City of Milford at all times.

Compiled from public records, 2026. Tariffs and interconnection rules change; verify with City of Milford before you rely on this. The useful move: if an installer says you need a main panel upgrade, ask how these tap and interconnection policies were considered first.
